This Privacy Policy applies to JVL Labs, Inc., JVL Systems, Inc., and all affiliated and related entities (collectively, "JVL," "we," "us," or "our"). JVL is committed to protecting the privacy of users who interact with our websites, platforms, products, and services (collectively, the "Site" or "Services"). We pledge to give you as much control as possible over your personal information and will not disclose individually identifiable information about you to any third party without your consent, except as described in this Policy.
Please read this Policy carefully to understand our policies and practices for collecting, processing, and storing your information. By accessing or using our Services, you indicate that you understand, accept, and consent to the practices described in this Privacy Policy. If you do not agree with our policies and practices, please do not use our Services. This Privacy Policy may change from time to time. Your continued use of our Services after we make changes indicates that you accept and consent to those changes.
This Policy is intended to comply with applicable privacy laws in Canada (including PIPEDA and applicable provincial legislation) and the United States, including state privacy laws where applicable.
1. Information We Collect
1.1 Automatically Collected Information
When you access our Services, we automatically collect certain technical information, including:
- IP addresses, for system administration, diagnostics, and session tracking
- Browser type, operating system, and referring URL
- Usage patterns, search queries, and subject areas visited, logged using session IDs only and not linked to individual member accounts
This information is analyzed in aggregate form and not linked to personally identifiable information.
1.2 Registration Information
Certain features of our Services require you to create an account. Registration requires your full name, email address, ZIP/postal code, username, and password. Additional information (such as age, mailing address, phone number, and employer) is optional and will be marked as such. For specific contests, surveys, or forum features, we may request additional information; participation in these is entirely voluntary.
1.3 Payment and Financial Information
When you purchase products or services or initiate financial transactions through our Services, we collect payment information necessary to process your transaction. JVL uses third-party payment providers to facilitate ACH transfers and other electronic payment transactions. Financial information you provide is used solely for billing and transaction processing purposes. JVL does not store full payment account credentials on its own systems; such information is transmitted directly to and handled by our payment providers in accordance with their security standards. Our payment providers’ collection and use of your financial information is governed by their own privacy policies and terms of service, which you may be required to accept in order to use payment features of our Services. We will not share your financial information with any other third party except as required to complete your transaction or comply with applicable law.
1.4 User Contributions
You may provide content to be posted on public areas of the Site or transmitted to other users ("User Contributions"). User Contributions are posted and transmitted at your own risk. We cannot control the actions of other users with whom you share your User Contributions, and we cannot guarantee that unauthorized persons will not view such content.
1.5 Cookies and Tracking Technologies
JVL uses cookies—small data files written to your device—to maintain your session state, store your member ID, and track where you are in the Site. JVL does not store personally identifiable information in cookies. Cookies cannot read other data from your device, transmit viruses, or access cookies from other sites. You may disable cookies in your browser settings; however, some features of our Services may not function properly without them.
1.6 Third-Party Tracking Technologies
Some content and applications on our Site, including advertisements and analytics tools, are served by third parties who may use cookies or other tracking technologies to collect information about your online activities over time and across different websites. These third parties may use this information to serve interest-based advertising. We do not control these third-party tracking technologies. If you have questions about targeted advertising from a third party, please contact that provider directly. You may also opt out of certain third-party ad networks as described in the Opt-Out Features section below.
2. How We Use Your Information
JVL uses collected information for the following purposes:
- To provide, maintain, and improve our Services and user experience
- To process payments and fulfill transactions, including via third-party payment providers
- To verify your identity and authenticate access to your account
- To communicate with you about your account, transactions, and updates to our Services
- To send you promotional or marketing communications (with your consent, where required)
- To analyze usage data in aggregate form to understand how users interact with our Services
- To comply with legal obligations, resolve disputes, and enforce our agreements
- To protect the rights, property, or safety of JVL, our users, and others
Personally identifiable information is held in strictest confidence and is not shared outside of JVL except as specifically described in this Policy.
3. Information Sharing and Disclosure
3.1 Service Providers and Business Partners
We may share your personal information with contractors, service providers, and business partners who support our operations—including payment providers, analytics providers, hosting services, and customer support platforms—who are contractually obligated to: (a) keep personal information confidential; (b) use it only for the purposes for which it is disclosed; and (c) process personal information in accordance with the standards set out in this Policy and applicable law.
3.2 Legal Requirements
We may disclose your personal information: (i) to comply with any court order, law, legal process, or government or regulatory request, in accordance with applicable law; (ii) to enforce or apply our Terms of Use or other agreements, including for billing and collection purposes; or (iii) if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of JVL, our users, or others.
3.3 Corporate Transactions
In the event of a merger, acquisition, restructuring, sale of assets, or similar transaction involving any JVL entity, personal information held by that entity may be transferred to the acquiring or successor entity, subject to the same privacy commitments described in this Policy. We will notify users of any such change in ownership or control of personal information.
3.4 Cross-Border Transfers
JVL operates across Canada and the United States, and your personal information may be processed, stored, or transferred between these jurisdictions. Governments, courts, or regulatory authorities in those countries may have access to your personal information under applicable law. Whenever we engage a service provider in a foreign jurisdiction, we require that its privacy and security standards adhere to this Policy and applicable Canadian privacy legislation. By submitting your personal information or engaging with our Services, you consent to this transfer, storage, and processing.
3.5 Aggregate and De-Identified Data
We may share de-identified, aggregated, or anonymized data that cannot reasonably be used to identify you, without restriction.
4. Identity Verification and KYC
To comply with applicable financial regulations and the requirements of our payment processing partners, JVL may collect and process information for Know Your Customer (KYC) and identity verification purposes. This may include:
- Government-issued identification documents
- Date of birth and tax identification numbers (such as SSN or EIN)
- Business registration information for corporate customers
This information is collected to verify your identity, prevent fraud, and meet anti-money laundering (AML) and related regulatory obligations. It is shared with our payment processing partners only to the extent necessary to complete verification.
5. Data Retention
We retain your personal information only for as long as necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, or regulatory requirements. Retention periods vary depending on the type of information and the applicable legal framework. For example:
- Account and registration data is retained for the duration of your account and for a reasonable period thereafter
- Transaction and payment records are retained as required by applicable tax, financial, and anti-money laundering laws
- Usage and log data is retained for a limited period for security and diagnostic purposes
We may anonymize your personal information when it is no longer needed, and reserve the right to use such anonymized data for any legitimate business purpose without further notice.
6. Cookies and Opt-Out Features
You may control how we use your information as follows:
- To opt out of promotional communications from JVL, select the opt-out option at registration or send an email to webmaster@jvl.ca
- To opt out of third-party marketing communications facilitated by JVL, opt out at registration or contact us at webmaster@jvl.ca
- To opt out of interest-based advertising from third-party ad networks, visit the relevant opt-out tools provided by those networks. Opting out does not mean you will stop receiving online advertising; it means the relevant network will no longer serve you ads tailored to your behavior
- You may also decline to provide personal information to us, though this may limit your ability to use certain features of our Services
7. Security
JVL uses industry-standard security measures to safeguard all information, including firewalls, Secure Socket Layer (SSL) encryption, and access controls. Your password is an important component of our security system; you are responsible for keeping it confidential and should change it immediately if you believe it has been compromised. Do not share your password with any third party.
Despite our efforts, no method of transmission over the Internet or electronic storage is completely secure. We cannot guarantee the absolute security of your personal information transmitted to our Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy or security measures contained on our Site.
8. Accessing and Correcting Your Personal Information
We are committed to maintaining accurate and current personal information. Subject to applicable law, you have the right to:
- Request access to the personal information we hold about you
- Request correction of inaccurate or incomplete personal information
- Withdraw your consent to the collection, use, or disclosure of your personal information, where applicable
- Request deletion of your personal information, subject to legal retention requirements
To exercise any of these rights, please contact us at privacy@jvl.ca. We may require you to verify your identity before fulfilling your request. Applicable law may allow or require us to decline certain requests; if so, we will explain the reason, subject to any legal restrictions. Note that if you delete User Contributions from the Site, copies may remain in cached or archived pages or may have been copied or stored by other users.
9. Children’s Privacy
Our Services are not directed to children under the age of 13 (or the applicable age of digital consent in your jurisdiction). We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child without appropriate parental consent, we will take steps to delete such information promptly. If you believe we may have collected information from a child, please contact us at privacy@jvl.ca.
10. Third-Party Links
Our Site may contain links to third-party websites. JVL is not responsible for the privacy practices of those websites. We encourage you to review the privacy policies of any third-party site you visit. This Privacy Policy applies solely to information collected through our Services.
11. Canadian and U.S. Privacy Laws
JVL’s privacy practices are designed to comply with applicable Canadian privacy law, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial legislation. To the extent JVL Systems, Inc. or other JVL entities collect personal information from U.S. residents, we also endeavor to comply with applicable U.S. state privacy laws, including but not limited to the California Consumer Privacy Act (CCPA) and similar statutes. California residents and residents of other states with applicable privacy laws may have additional rights; please contact us at privacy@jvl.ca for more information.
12. Notification of Changes
If we decide to change this Privacy Policy, we will post the updated Policy on our Site and, where required by law, notify registered users by email. Your continued use of our Services after the effective date of any changes constitutes your acceptance of the updated Policy. Users may always opt out of communications from JVL by emailing webmaster@jvl.ca.
